Abstract
보조금협정은 WTO의 반덤핑협정과 함께 많이 다투어지고 있는 협정 중의 하나이다. 조선, 항공 등 일부 분야는 그 산업의 특성상 정부의 보조금 지원이 불가피한 측면이 있기 때문에 선진국이라 하여도 지속적으로 보조금을 지급하고 있어 미국, EU, 캐나다 등의 선진국이 피제소국이 되는 사례가 빈번하다. 우리나라도 조선업계에 대한 보조금 지급문제로 EU와 상호 맞제소한 사례가 있다. 분쟁 발생시 성공적인 방어를 위해서는 보조금협정을 제대로 이해하는 것이 필요하며, 보조금협정의 바른 이해는 정책 마련시에도 역시 필요하다. 보조금협정 제3조는 금지보조금인 수출보조금 및 수입대체 보조금에 대하여 규정하고 있다. 제3조 제1항(a)는 법률상 또는 사실상 수출실적에 따라 지급되는 보조금을 금지하고 있는데, 법률상 수출실적에 따라 지급되는 보조금의 의미에 대하여 Canada - Autos 사건의 항소기구는 관련 법률이 명시적인 표현이 아닌 암묵적 표현을 사용하고 있더라도 이에 해당하는 것으로 해석한다고 판단하였다. 다음으로 사실상 수출실적에 따라 지급되는 보조금의 의미에 대해서는 Canada - Aircraft 사건에서 다루어졌는데, 이 사건 항소기구는 각주4의 요건 중 보조금의 지급이 실제 또는 예상되는 수출 또는 수출 수입과 결부되어져야 한다는 요건을 핵심요건으로 보아 보조금의 지급과 수출 간의 의존성 또는 조건성이 충족되어야 한다고 판단하였다. 보조금협정 제3조 제1항(b)는 수입품 대신 국내 상품의 사용을 조건으로 지급되는 보조금에 대하여 규정하고 있는데, 제1항(a)와 달리 사실상 그러한 조건 하에 지급되는 보조금이 금지되는지에 대해서 침묵하고 있다. 이 부분의 해석에 대하여 Canada - Autos 사건 항소기구는 GATT 제3조 제4항과의 균형성 유지 및 보조금협정의 대상 및 목적을 고려하여 사실상 국내 상품의 사용을 조건으로 지급되는 보조금 역시 동 조항에 의하여 금지된다는 판단을 내렸다. 이에 대하여는 문언을 넘어서는 해석이라는 비판이 가능할 것이다. 보조금협정과 농업에 관한 협정과의 관계에 대해서 보조금협정 제3조 제1항 두문에서 언급하고 있는데, 농업에 관한 협정에서 다루지 않고 있는 농산물에 대한 수입대체 보조금이 허용되는지 여부에 대하여 Upland - Cotton 사건의 항소기구는 농산물에 대한 수입대체 보조금 역시 보조금협정에 따라 금지된다고 판단하였다. 또한 US -FSC 이행소송에서 패널은 보조금협정 제3조 제1항의 위반은 제2항의 위반을 동반한다고 판단하였다.
