Abstract
El presente artículo se analiza algunos de los procesos de reorganización empresarial que se han tramitado en la ciudad de Cartagena de Indias, desde el punto de vista jurídico y socio-jurídico; teniendo en cuenta en este ejercicio, los aspectos que emergen en el desarrollo del proceso concursal, teniendo como referente normativo principal la Ley 1116 de 2006, sancionada el 27 de diciembre de 2006, y la cual entró en vigencia el 27 de junio de la siguiente anualidad. Esta Ley contiene el nuevo Régimen Concursal Colombiano, que contempla tres nuevos aspectos del Derecho Concursal: los Procesos de Reorganización, la Liquidación Judicial y la Insolvencia Transfronteriza, tanto en materia de procesos de Recuperación o salvamento, como en procesos de liquidación del patrimonio del deudor. De igual manera se vislumbra, de lo poco atractivo que resulta el concurso de acreedores debido al poco conocimiento del mismo, por parte del deudor, así como el papel que desempeña el Derecho concursal en el diseño de la estructura económica y financiera de las empresas, en el acceso al crédito, en el grado de re- emprendimiento, innovación y competitividad de las organizaciones, y, más genéricamente, en la promoción del crecimiento económico.
