Les problèmes liés à la disponibilité de l’eau douce se sont intensifiés dans les dernières années. L’importance de concevoir des modèles politico-juridiques innovateurs pour la gestion et gouvernance des ressources au niveau national et international est de nos jours un enjeu majeur. C’est dans ce contexte que nous analyserons l’évolution du droit international des eaux transfrontalières en Amérique du Nord, notamment par rapport à l’évolution des relations entre le Canada et les États-Unis ainsi qu’entre les États-Unis et le Mexique. Nous observerons que les tensions, négociations et solutions retenues pour la distribution de l’eau diffèrent fortement au sein même du continent, des réalités qui reflètent la double rationalité concernant la gestion des ressources hydriques partagées. Nous présenterons plus précisément l’opposition entre ceux en faveur de la création de nouveaux marchés de l’eau et ceux qui encouragent la préservation de l’eau et de l’environnement.
