Abstract
Alors que nous baignons dans une rhétorique néo-libérale depuis le début des années 80, il est frappant de relever à quel point le professeur Jacques-Yvan Morin met l’accent sur la pleine reconnaissance des droits économiques et sociaux comme précondition essentielle de l’épanouissement de la démocratie politique. L’étude qui suit examine l’impact de la Charte des droits et libertés de la personne sur le droit des rapports collectifs du travail, en partant de certains éléments de l’étude de Jacques-Yvan Morin : la genèse des droits fondamentaux de la personne, au regard de l’idée de droit naturel; la qualité de droit fondamental des libertés syndicales, y compris du droit de grève; enfin, la prépondérance de la Charte québécoise sur la législation ordinaire et sa protection contre la tyrannie de la majorité.
