Abstract
Après avoir rappelé les fondements philosophiques et juridiques du droit à l’égalité et l’évolution prodigieuse qu’il a connu au cours des derniers siècles, l’auteur montre que la Charte québécoise tant souhaitée par Jacques-Yvan Morin s’inscrit dans ce mouvement historique. Il est clair que ce droit fondamental en démocratie, véritable pierre angulaire de la Charte québécoise, ne se réduit plus à l’idée d’égalité formelle. Malheureusement, c’est le constat de l’auteur, les tribunaux supérieurs, à commencer par la Cour d’appel, ne semblent pas en phase avec l’évolution qu’a connue le droit à l’égalité, ce qui en réduit considérablement la portée et les promesses au Québec.
