Abstract
Hava yolu taşımacılığı, günümüzde en güvenli ve en hızlı ulaşım biçimi kabul edilmektedir. Ancak hava yolu ulaşımında da elim kazaların meydana geldiği ve bu olaylar neticesinde kazazede ya da mirasçılarının taşıyıcının sorumluluğuna başvurdukları bilinen bir olgudur. Sorumluluk davaları, Türkiye’de açılabildiği gibi yabancı devlet mahkemelerinde de açılabilmektedir. 5 Şubat 2020 tarihli İzmir-İstanbul uçuşu yapan PC2193 sefer sayılı Boeing 737 tipi uçağın pisten çıkması sonucu çeşitli davaların açılması gündeme gelmiştir. Medyaya da yansıdığı üzere, kaza ile ilgili sadece Türkiye’de değil ABD’de de dava açıldığı ve yurt dışından yabancı avukatların da Türkiye’ye geldiği görülmüştür. 1999 tarihli Montreal Sözleşmesi uluslararası taşımalarda yolcunun ölmesi, yaralanması ile geciktirilmesi halleri ile kargo ile bagajın gecikmesi, hasara uğraması ve kaybı durumlarında taşıyıcının sorumluluğunu düzenleyen ve Türkiye’nin de taraf olduğu sivil havacılığa dair önemli bir düzenlemedir. Yeknesaklaştırma amacı güden bu milletlerarası özel hukuk sözleşmesi, taşıyıcı aleyhine açılabilecek davaların muhtemel forumlarını açıkça düzenleyerek sınırlandırmıştır. Bu çalışmada, öncelikle uluslararası taşımadan doğan bir sorumluluk davasına hangi taraf devletteki mahkemenin bakacağı meselesi Montreal Sözleşmesi madde 33’teki açık düzenleme ışığında ele alınmış ve özellikle de madde 33/f.2’de sadece yolcunun ölümü ve bedensel zarara uğraması halinde geçerli olan beşinci yetki kuralı, güncel mahkeme kararları ışığında tartışılmıştır.
