Abstract
Si le rapt de séduction et les mariages clandestins sont considérés comme des crimes punissables de mort depuis le XVIe siècle, l’étude des archives judiciaires de la Nouvelle-France montre que, comme en métropole, les juges en poste au Canada sous le Régime français se refusent à condamner si durement ce qui découle souvent de conflits relatifs à l’honneur des familles. En 1753, l’affaire Rouffio, du nom d’un jeune justiciable de Québec convaincu de crime de rapt, donne lieu à une tentative de transaction financière entre les familles concernées, impossible juridiquement, mais finalement entérinée en appel par le Conseil supérieur qui juge ici en équité plutôt qu’en droit.
