Abstract
Latar Belakang: Banyak perusahaan yang tidak memasukan pasal-pasal terkait kesehatan dan keselamatan kerja di dalam buku Perjanjian Kerja Bersama dan ternyata banyak sekali didalam Al-Quran beserta Hadist yang membahas mengenai Keselamatan dan Kesehatan Kerja (K3) dalam aspek lingkungan kerja, aspek manajemen, aspek tenaga kerja. Tujuan: Untuk mengetahui keselarasan antara hukum islam dan peraturan perundangan dalam aspek lingkungan kerja, aspek manajermen dan aspek tenaga kerja yang tertuang dalam Buku Perjanjian Kerja Bersama (PKB) di PT.Unitex Tbk tahun 2019. Metode: Penelitian ini menggunakan pendekatan deskriptif dengan studi Gap Analisis yaitu perencanaan kegiatan di masa depan pada suatu perusahaan dan dekstop study yaitu melihat dokumen internal maupun eksternal milik perusahaan kemudian pengisian lembar checklist dalam melakukan pengambilan data serta wawancara mendalam dengan ahli agama, ahli hukum, HRD perusahaan, serikat pekerja, dinas tenaga kerja. Hasil: Penelitian ini menunjukan bahwa dari ketiga aspek didalam buku Perjanjian Kerja Bersama (PKB) PT Unitex pada umumnya sudah selaras dengan hukum perundangan dan hukum islam. Kesimpulan: Adanya keselarasan 100% dalam aspek lingkungan kerja dengan hukum perundangan dan hukum islam, adapun dalam aspek manajemen pada umumnya 80% sudah selaras dengan hukum perundangan dan hukum islam, serta dalam aspek tenaga kerja kurang selaras dengan hukum islam dan hukum perundang-undangan karena presentase keselarasannya hanya 40% (rendah). Saran: Maka PT Unitex Tbk perlu lebih banyak lagi memasukan pasal terkait Kesehatan dan Keselamatan Kerja di dalam buku Perjanjian Kerja Bersama dan lebih memperhatikan tenaga kerjanya terutama tenaga kerja wanita.
