L’emergence importante de technologies durant notre ere a force le gouvernement quebecois a actualiser et a preciser les regles existantes en matiere de contrats de consommation conclus a distance. C’est en 2006 qu’il introduit la Loi modifiant la Loi sur la protection du consommateur et la Loi sur le recouvrement de certaines creances. Le 25 octobre 2011, le Parlement europeen et le Conseil de l’Union europeenne adoptent la directive 2011/83/UE, ayant comme objectif de contribuer au bon fonctionnement du marche interieur et d’assurer un haut niveau de protection pour le consommateur europeen en matiere de contrat a distance. Le present article a pour objectif de proceder a une etude comparative de la legislation quebecoise et de la legislation europeenne en matiere de contrat a distance, en prenant soin d’identifier les ressemblances et les differences des deux regimes.
