Abstract
Penulisan ini bertujuan untuk memberikan pengetahuan dalam hukum pengangkutan udara internasional, apakah perbuatan awak kabin dapat dimintakan pertanggung jawabannya secara hukum dan bagaimana perusahaan angkutan udara bertanggung jawab kepada penumpang yang mengalami kerugian. Jenis penelitian dalam penulisan hukum ini menggunakan penelitian yuridis empiris. Penelitian yuridis empiris adalah penelitian hukum mengenai pemberlakuan ketentuan hukum normatif (konvensi, undang-undang atau kontrak) secara in action pada setiap peristiwa hukum tertentu yang terjadi dalam masyarakat. Hasil dari penulisan ini adalah bahwa perbuatan awak kabin tersebut dapat dimintakan pertanggung jawabaannya secara hukum berdasarkan prinsip perbuatan melawan hukum dalam pengangkutan internasional yaitu prinsip tanggung jawab mutlak dan untuk mendapatkan tanggung jawab berupa ganti kerugian terhadap korban yaitu korban terlebih dahulu harus mengajukan gugatan di pengadilan dimana korban dapat mengakses lebih mudah artinya dapat diajukan atas pilihan penggugat. Pada kasus ini penggugat mengajukan gugatan di pengadilan penggugat bertempat tinggal. Disarankan negara-negara peserta Konvensi Montreal 1999 agar kedepannya dapat mengatur lebih banyak pasal-pasal kerugian yang belum diatur dan diharapkan kepada pihak pengangkut udara untuk tidak melakukan diskriminasi kembali kepada penumpang penyandang disabiilitas serta diharapkan hakim dalam menyelesaikan perkara ini dengan seadil-adilnya.
