En el presente escrito, el cuestionamiento radica en si se hace necesario redefinir o repensar –dentro del Contrato Administrativo– la presencia y alcance de fuertes potestades y prerrogativas públicas, como de la esencia de dicho acto jurídico, denominadas aun hoy en día, como las clausulas exorbitantes del Derecho privado. Y para realizar un renovado abordaje de este tema, debemos necesariamente focalizar –como cuestión prioritaria– la finalidad que persigue la contratación publica, esto es, la satisfacción de los intereses públicos, de los intereses de la sociedad involucrados en cada contrato, circunstancia que diferencia a esos actos jurídicos de los contratos del Derecho privado.
