El paradigma moderno concibe a la naturaleza en una relación de disyunción, de separación entre objeto y sujeto. Esto en el modelo jurídico, en formalización y cosificación de las relaciones sociales, lo que no permite apreciar los fenómenos naturales y sociales en su integridad. Los avances en materias de derecho internacional y constitucional significan una evolución, pero no alcanzan a ser suficientes, ya que mantienen la metodología de resolución de conflictos por imputación y subsunción por lo que reitera la reducción de los procesos bio-psico-sociales a la forma. La holística de la realidad obliga a crear nuevas metodologías para trabajar en sistemas complejos e inestables, lo que impone la obligación de pensar otro derecho.
