Abstract
Cet article s’intéresse à la question du droit au consentement préalable, libre et éclairé (CPLE) dans le contexte de l’industrie hydroélectrique québécoise et à l’important rôle énergétique et économique qu’elle joue pour la province. En l’absence de législation spécifiquement axée sur la mise en oeuvre de la Déclaration des Nations unies sur les droits des peuples autochtones (DNUDPA) au Québec, l’auteur analyse les dynamiques relationnelles entre Hydro-Québec et les nations crie et innue afin de vérifier dans quelle mesure les composantes et pratiques de l’industrie hydroélectrique peuvent permettre à elles seules de favoriser une mise en oeuvre adéquate du droit au CPLE. L’article révèle enfin l’absence de normes et de pratiques capables de garantir l’obtention d’un véritable CPLE et illustre une longueur d’avance dans la qualité du consentement obtenu chez les Cris d’Eeyou Istchee, en comparaison avec les Innus de la Côte-Nord. Des recommandations quant à la mise en oeuvre du CPLE font suite à ces constats.
