Abstract
Les peuples autochtones au Canada cherchent à développer des outils leur permettant de mieux affirmer leurs droits et d’exercer un certain contrôle sur les processus consultatifs auxquels ils sont assujettis dans le cadre des projets de développement du territoire. Cette affirmation passe notamment par l’adoption de protocoles unilatéraux. Cet article analyse vingt-deux de ces protocoles afin d’en saisir les fondements et les finalités juridiques et politiques et souligne leur nature relationnelle, malgré leur caractère unilatéral. Ils visent en effet à combler le vide entre le droit coutumier autochtone et le droit étatique et international en matière de consultation et de consentement préalable, libre et éclairé, et permettent en ce sens de donner à ces protocoles une portée concrète.
