Abstract
مقاله «فقه و قرآن» ( Law and the Qur'an) از جمله مقالات دائرة المعارف قرآنی لایدن است که آقای وائل حلاق (Wael Hallaq) [1] آن را نگاشته است و در آن بیان میکند که قرآن نقش (عملکرد) شگرفی در فقه اسلامی دارد. در میان چهار منبع اصلی فقه اسلامی (شریعت)، بدون تردید قرآن اولین و مهمترین آنها محسوب میشود. اگر چه به لحاظ احکام اساسی (ذاتی) و در مقایسه با مجموعة کامل شریعت، قرآن بخش نسبتا کمتری از موضوعات حقوقی را در اختیار میگذارد، ولی تعداد معدودی از اساسیترین احکام حاکم بر زندگی فردی و اجتماعی مسلمانان، صراحتا در قرآن بیان شده و یا از دیگر آیات آن استنباط میشود. محوریت قرآن در شریعت (فقه) بیشتر برخاسته از ملاحظات مذهبی و فکری بوده و کمتر از توانایی آن در تأمین موضوعات فراوان فقهی (قانونی) ناشی میشود. ناقد در این مقاله دیدگاههای وائل حلاق را به نقد کشیده است و در مورد یک سوانگاری نویسنده که فقط از منابع اهلسنت استفاده کرده و به منابع شیعه مراجعه نکرده و در مورد تعداد آیات الاحکام (500 آیه) و مقایسة احکام قرآن با تورات خرده میگیرد.
