Abstract
Die Regierungen unter Petro Poroschenko und Wolodymyr Selenskyj brachten eine Vielzahl institutioneller und legislativer Änderungen im Justizwesen auf den Weg. Das Versprechen der Revolution der Würde, für Rechtsstaatlichkeit zu sorgen, ist jedoch weitgehend unerfüllt geblieben. Die Auswirkungen der ambitionierten Umstrukturierung des Gerichtswesens auf richterliche Normen und Praxis blieben gering. Dafür gibt es mehrere Gründe: Erstens ist das Bekenntnis der politischen Elite zum Rechtsstaat bestenfalls oberflächlich und schlimmstenfalls vorgetäuscht. Zweitens besteht in der Richterschaft selbst nur eine schwache Lobby, die dafür eintritt, Reformen voranzutreiben, diese ernst zu nehmen und umzusetzen. Die Reformstrategie, der Richterschaft mehr Selbstverwaltung zu gestatten, war fehlgeleitet. Vielmehr sollte die Kontrolle der Auswahlverfahren für Richter durch die Zivilgesellschaft und internationale Experten ausgebaut werden.
