Abstract
Dès la deuxième moitié du xixe siècle, les juristes spécialistes du droit colonial semblent fort sensibles à l’intégration des savoirs extra-juridiques, émanant du milieu des sciences naturelles et sociales, dans leurs discours et pratiques. Cette attitude se manifeste de manière d’autant plus évidente dans la définition des rapports juridiques entre français et indigènes, lorsqu’il s’agit d’encadrer des cas hybrides ou limites. Comment les spécialistes du droit d’outre-mer sélectionnent-ils et utilisent-ils ces connaissances dans la pratique quotidienne du droit ? De quelle manière se construit-il le dialogue entre les juristes et les autres savants ? Quels sont les enjeux de l’usage de ces savoirs ? Cet article aborde ces problématiques, en se concentrant sur la mobilisation des études des orientalistes et de l’anthropologie physique dans la construction des catégories d’« étrangers assimilés aux indigènes » et de « métis ».
