Abstract
O artigo analisou a tese número 210 do Supremo Tribunal Federal, pelo qual a Suprema Corte decidiu que, no transporte internacional de passageiros, as indenizações por danos à bagagem são limitadas a 1000 Direitos Especiais de Saque, conforme o artigo 22, ponto 2 da Convenção de Varsóvia-Montreal. Utilizando-se dos métodos indutivo e dialético, observou-se uma incompatibilidade entre a tese firmada e a garantia da reparação integral do dano, da proteção ao consumidor e o conceito de eficiência da Análise Econômica do Direito. Portanto, referido entendimento é inconstitucional.
