Abstract
This article tackles the controversy about the appropriate legislation – the Montreal Convention or the Consumer Code – dealing with international air travel in Brazil. To render it possible, the Federal Constitution, the Civil Code and the Consumer Code will the analysed. Also, a new interpretation of the criteria involving the solution of conflicting laws in consumer protection is proposed. In the end, the position of the Brazilian Supreme Court on the subject will also be debated.
