Abstract
La cura istituzionale per i bambini piccoli, in tutta la storia del mondo, dell’America Latina e del Brasile, ha presentato diverse concezioni sulla loro funzione. La maggior parte di queste istituzioni erano destinate a servire solo i bambini poveri. Tuttavia, è molto recente l’istituzione di una politica nazionale per la prima infanzia, come investimento pedagogico, sociale, nella salute materna e infantile, economica ed educativa, che considera i bambini come soggetti di diritti e cittadini nel processo di sviluppo. Così, questo articolo intende ricostituire la traiettoria della nuova legislazione sulla prima infanzia, che obbliga i manager e i professionisti dell’istruzione, dell’assistenza sociale, della salute, della psicologia, della psichiatria in tutto il paese ad adattare le loro attività alle norme stabilite dalla legge. Detto questo, questo studio si basava su prove scientifiche; argomenti pedagogici e giuridici diffusi in Brasile negli ultimi tre decenni, soprattutto dopo la Costituzione dei cittadini del 1988, che ha promosso l’evoluzione della legislazione della prima infanzia. In cui è stato possibile osservare che solo nel 2006, con la creazione di FUNDEB, sono stati istituiti finanziamenti per l’istruzione della prima infanzia; nel 2016, il quadro giuridico della prima infanzia è stato sanzionato. E nel 2020, per la prima volta nella storia, l’infanzia è stata menzionata e inclusa negli allegati di tredici leggi dei piani plennali delle entità federate brasiliane, che es hanno effetto dal 2021 al 2023.
