Abstract
La question de la protection territoriale de la marque sur un site Internet semble avoir trouvé une solution satisfaisante en jurisprudence. Les juridictions prennent en considération le public visé par le site incriminé pour déterminer s’il porte ou non atteinte à la marque et s’il se rend coupable de contrefaçon. Pour déterminer la clientèle visée par un site québécois, trois critères ont été dégagés : l’accessibilité du site en France, l’utilisation de la langue française et le défaut d’exclusion des acheteurs français. Le caractère insuffisant des critères peut apparaître en jurisprudence pour déterminer si le site est destiné à la clientèle française lorsque l’offre émane d’un site francophone. Exclure les consommateurs de tel ou tel État des offres proposées sur son site est une solution préconisée pour l’entreprise de commerce électronique.
