Dans un espace mondialis o d'innombrables processus conomiques et sociaux traversent quotidiennement les frontires nationales, il semble aller de soi que la rgulation politique et juridique ne saurait tre que plurielle 1 . Dans une culture plantaire domine par la croissance infinie de la richesse matrielle et par l'innovation technologique, il semble vident que le respect des tres humains ne saurait tre assur que par l'affirmation du droit la protection de la dignit humaine comme valeur minente des ordres juridiques nationaux et supranationaux 2 .
