Abstract
Regulado desde a sua instituição por dois ? entretanto arqueológicos ? diplomas da década de 30 do século XX, há muito que o Tribunal dos Conflitos era merecedor de reforma. Pese embora não formalmente inserida no pacote legislativo que deu corpo, em 2019, à designada «Reforma da Jurisdição Administrativa e Fiscal», a Lei n.º 91/2019, de 4 setembro, veio finalmente proceder à reconfiguração orgânica e à revisão do regime processual aplicável a uma instância histórica do sistema judicial português, mas cuja atuação é ainda decisiva para a delimitação da área de intervenção dos órgãos da jurisdição administrativa e fiscal e, com isso, para o próprio refinamento das fronteiras do Direito Administrativo (e do Direito Fiscal) perante os demais subconjuntos do ordenamento jurídico. Dividido em duas partes, é pois à análise da nova Lei do Tribunal dos Conflitos, enquanto peça que faltava na arquitetura institucional e funcional do Processo Administrativo, que se dedica o texto. Nesta primeira parte, para além do necessário enquadramento ao tema, começa-se por examinar a competência e a composição do Tribunal dos Conflitos.²
