Au Canada, s’il existe bien des proces de droit constitutionnel mettant en jeu des reglementations, telles que la taxe carbone federale ou des autorisations de projets d’oleoducs et de gazoduc, qui ont indirectement un lien avec les changements climatiques, peu de recours « climatiques » a proprement dit ont ete intentes devant le juge canadien, jusqu’a celui loge par l’ONG Environnement Jeunesse contre le gouvernement canadien, en 2019. Cette rarete du contentieux climatique canadien amene a s’interroger sur les raisons pouvant potentiellement l’expliquer. L’analyse de cette affaire ne devient vraiment interessante que lorsqu’elle benefice de l’eclairage qu’apporte la comparaison des vehicules proceduraux utilises et des moyens substantifs plaides, dans pareilles affaires, ailleurs dans le monde.
