Abstract
O presente trabalho objetiva trazer uma análise crítica do Caso Laval, que tratou de pleito perante o Tribunal de Justiça da União Europeia (TJUE) entre a empresa da Letônia Laval e três entidades sindicais da Suécia. A referida empresa, ao ganhar concurso para construção de escola, optou por deslocar empregados de sua sede em Riga, na Letônia, para a Suécia, local da obra. Ao proceder de tal forma, a empresa estaria se beneficiando dos padrões de proteção social mais baixos no país de origem, incorrendo em dumping social, o que mobilizou os sindicatos do país receptor a iniciarem greves contra a companhia. Assim, estabeleceu-se um conflito entre princípios fundamentais: de um lado, as liberdades sociais coletivas; e, de outro, as liberdades econômicas. O TJUE, ao ponderar entre os princípios, decidiu que a liberdade de prestação de serviços em outro Estado-membro é norma fundante da União Europeia e serve como limitação ao exercício de greve, que, nesse caso, foi considerada excessiva. Como conclusão, pode-se dizer que o TJUE, ao sopesar os direitos sociais e os direitos econômicos, acabou atribuindo prevalência aos últimos.
