Abstract
Au Canada, l’absence de prescription en matière criminelle a permis, depuis les années 1990, la construction d’un cadre juridique permettant l’accueil de plaintes sur des faits datant de plusieurs décennies. L’article se concentre sur des procès tenus au Québec entre 2001 et 2017 pour des agressions sexuelles sur mineurs, commises dans le cadre familial entre les années 1950 et 1980. Les procès-verbaux qui en résultent, appréhendés comme une archive sur les silences des victimes et de celles et ceux qui savaient, permettent d’analyser les raisons pour lesquelles les faits n’ont donné lieu à aucune réaction institutionnelle au moment de leur commission. Ils renseignent aussi sur les modalités de rupture de ces silences, du cheminement vers la plainte à l’évaluation des paroles dans l’enceinte du procès.
