Abstract
La Convention européenne des droits de l’homme et son interprète authentique n’étaient pas préparés à répondre aux questions sociétales posées par le domaine, en mutation rapide et constante, de la biomédecine. La Convention n’en a pas moins saisi ces questions au prisme des droits subjectifs, de manière souvent tout à fait différente des États eux-mêmes, qui y voyaient plutôt des enjeux de santé publique et d’ordre public, protégeant des valeurs collectives ou laissant au marché le soin de réguler les comportements. La Cour a donc, comme ailleurs, mais avec plus d’audace encore, ouvert son prétoire et élargi le champ des articles 2, 3, 8 et 14 à l’assistance à la reproduction, au prélèvement et usage des éléments corporels, à la recherche biomédicale et à l’accès aux soins innovants. Les techniques biomédicales sont devenues des droits. Ce faisant, la Cour a ressenti la gêne et connu les débats qu’une telle approche suscite entre choix de société, pluralisme et retenue. Il n’est pas anodin de transformer des choix axiologiques nationaux en conflits de droits subjectifs ou de mener à des exceptions via un contrôle concret que les juges nationaux n’utilisent guère. L’usage indécis de la marge d’appréciation en témoigne.
