Abstract
Dans un marché mondial de procréation fort évolutif, la GPA en tant que forme de maternité de substitution, se pratique aujourd’hui de plus en plus et suscite de nombreuses problématiques éthiques en termes de respect de la dignité des femmes, d’indisponibilité de son corps, de prise en compte de l’intérêt supérieur de l’enfant à naitre et d’établissement de sa filiation. Face à de tels questionnements éthiques, la réponse juridique en droit international fut timide alors que celle des États fût foncièrement disparate variant entre des régimes d’interdiction ou d’encadrement légal de cette pratique et d’autres qui la tolèrent, mais ne la réglementent pas. Cet article propose d’analyser les différents enjeux éthiques que soulève la GPA, avant de s’arrêter sur les divers courants juridiques interdisant ou autorisant totalement ou partiellement cette pratique, tout en étudiant le traitement juridique réservé par le droit international à cette question.
