Cette contribution décrit la situation juridique actuelle de l’utilisation militaire de l’espace extra-atmosphérique au sens du droit international public. Les principales étapes de la course à l’espace, ses utilisations à des fins militaires et les technologies militaires actuelles utilisées dans cet environnement singulier sont brièvement présentées. Les principales caractéristiques du droit de l’espace sont ensuite décrites succinctement. À travers un exercice d’interprétation critique des dispositions pertinentes de traités du droit de l’espace, du droit de la maîtrise des armements, de droit international général, mais également de droit international humanitaire, cette étude montre dans quelle mesure la militarisation de l’espace est bel et bien licite à ce jour. De plus, cet article démontre en quoi le déploiement d’armements dans l’espace ne contrevient pas, malgré quelques interdictions spécifiques, aux normes de droit international en vigueur. Actuellement, face à l’incapacité des institutions onusiennes à préciser la situation juridique et aux apports très limités des instruments non contraignants en la matière, seules des initiatives émanant de la société civile telles que le manuel de McGill et celui de Woomera, semblent être à même de clarifier, dans un futur proche, la lex lata en matière d’utilisation militaire de l’espace extra-atmosphérique.
