La Cour européenne des droits de l’homme fait appel à diverses sources de droit international afin d’interpréter les normes relatives aux droits de la personne énoncées dans la Convention européenne des droits de l’homme. Elle l’a souvent justifiée en se référant à l’article 31 (3) c) de la Convention de Vienne sur le droit des traités, qui invite l’interprète de tenir compte de « toute règle pertinente de droit international applicable dans les relations entre les parties ». Bien que la Cour ne fasse aucune distinction réelle entre les instruments de droit conventionnel qui peuvent être applicables et d’autres sources, telles que les résolutions, directives et principes adoptés au niveau international, elle ne considère presque jamais le droit international coutumier en tant que source de droits fondamentaux. Exceptionnellement, elle se réfère à la coutume internationale en ce qui concerne le principe de légalité, conformément au texte de l’article 7. La Cour a fréquemment examiné le droit international coutumier, mais sur des questions autres que les droits fondamentaux, comme les immunités des États. La Cour a également déclaré que certaines normes relèvent du jus cogens. L’article examine l’utilisation du droit international coutumier et du jus cogens par la Cour européenne des droits de l’homme et propose qu’à l’avenir, elle fasse une utilisation plus importante de ces sources.
