Abstract
En 2012, le législateur chinois a modifié la Loi de la République populaire de Chine sur la protection des droits et intérêts des personnes âgées pour y inclure l’obligation de rendre fréquemment visite aux parents (ORFVP). Elle mobilise une tradition chinoise confucéenne, ici la piété filiale, délaissée par la population selon le Parti communiste chinois. Les auteurs·rice·s démontrent qu’il s’agit d’une représentation véhiculée par le Parti communiste. En effet, si l’actualisation de l’ORFVP, et plus largement de la piété filiale, se heurte à de nombreuses difficultés, elle n’a pas disparu. Les juges chinois, loin d’adopter une attitude en surplomb, tentent d’aménager l’ORFVP en tenant compte des réalités des parties.
