Resumen En el último cuarto de siglo, en México, se han incrementado de manera notoria las medidas de control y verificación migratorias, enmarcadas en argumentos relacionados con la soberanía y la seguridad nacional. Las políticas migratorias restrictivas derivadas de este tipo de preocupaciones se han enfocado en la gestión de flujos migratorios, lo que ha tenido distintas consecuencias, no sólo en la producción de irregularidad migratoria sino, además, en los obstáculos que existen para que los migrantes se documenten de una forma segura. En este contexto, en combinación con una infraestructura deficiente y una burocracia ineficiente, los documentos que la Secretaría de Gobernación de México autoriza a muchos migrantes limitan su acceso al trabajo o a la movilidad dentro del país. Igualmente, los programas temporales de regularización migratoria que el gobierno mexicano ha ofrecido no producen más que formas precarias de legalidad que no eliminan la ilegalidad, sino que desdibujan la distinción entre ambas. Quienes no pueden alcanzar un estatus legal a través de los canales oficiales han recurrido a soluciones más “creativas” para estar “legalizados”, lo que llamamos “legalidad ilegal” en este artículo. Enfatizamos que estar en esta situación vuelve a los migrantes más vulnerables. A partir de la revisión de las disposiciones mexicanas relacionadas con la política migratoria y de los relatos de migrantes centroamericanos que están establecidos en México, nos enfocamos en el análisis del límite difuso entre la legalidad y la “ilegalidad” migratoria en México y de sus consecuencias en las condiciones de vida y de trabajo de estas personas migrantes.
