Abstract
Dans les arguments avancés par les États-Unis pour s’opposer au renouvellement des juges de l’Organe d’appel, il y a l’idée selon laquelle se développe dans le contentieux commercial multilatéral la règle du Stare decisis , et ce en violation à la fois des règles de droit international public général et du Mémorandum d’accord sur les règles et procédures de règlement des différends de l’OMC. Or, si la règle du précédent n’a pas d’autorité formelle en droit international public, il y a effectivement à l’OMC une tendance de ses organes juridictionnels à trancher les différends dans le sens des décisions antérieures. Dans cet article, les auteurs tentent de démontrer que, malgré les apparences, la pratique en cours à l’OMC ne relève pas du Stare decisis , mais plutôt d’une approche civiliste et pragmatique de jurisprudence constante.
