Abstract
La protection des droits fondamentaux de la personne n’était pas inscrite dans l’ADN de l’Union européenne. Les rédacteurs des textes originaires en 1957 n’ont envisagé à aucun moment le risque liberticide. Ce dernier est pourtant mis en évidence dès les années 1960 avec l’énoncé de l’idée que le législateur européen n’est pas forcément plus vertueux que le législateur national au regard du respect des libertés individuelles. Depuis s’est mis en place un processus de fabrication ininterrompu des droits fondamentaux de la personne, découvert par le juge, conforté par le constituant et parachevé par le législateur.
