Abstract
Uluslararası Hava Yolu Taşımasına İlişkin Belirli Kuralların Birleştirilmesine Dair Antlaşma ya da kısa adıyla Montreal Konvansiyonu, dünya genelinde yüz otuzun üstünde ülkenin taraf olduğu, sivil havacılığa ilişkin en önemli hukuki düzenlemelerden biridir. Hava yolu ile gerçekleştirilen uluslararası nitelikte taşıma sözleşmelerinden doğan uyuşmazlıklar açısından temel kaynak kabul edilebilecek Konvansiyon, ülkemiz tarafından da kabul edilerek, 2011 yılında yürürlüğe girmiştir. Her ne kadar, Montreal Konvansiyonu ülkemiz tarafından onaylanmasının ardından Resmî Gazete’de yayınlanan bir çeviri ile Türkçeye tercüme edilmişse de, bu resmi çeviri metninde birtakım hatalar, eksiklikler ve bazı anlatım bozuklukları bulunmaktadır. Her ne kadar resmi çeviri metninin, Montreal Konvansiyonu’nun aslı karşısında hukuki bağlayıcılığı bulunmasa da, uygulamada çoğu zaman bu çevirinin ilk başvuru kaynağı olacağı söylenebilir. İşte, bu çalışma ile Konvansiyonun aslına uygun şekilde tercüme edilmiş alternatif bir Türkçe metin sunmak amaçlanmaktadır. İki kısımdan oluşan çalışmanın ilk bölümünde resmi çevirideki hata ve eksiklikler kısaca değerlendirilerek çalışmanın gerekçeleri üzerinde durulacaktır. İkinci bölüm ise Konvansiyonun İngilizce aslı esas alınarak dilimize tercüme edilen çevirisinden müteşekkildir.
