Les négociations commerciales internationales portent sur des enjeux de plus en plus sensibles pour les États fédérés. Dans ce contexte, plusieurs États fédérés prennent conscience que leurs compétences constitutionnelles et leur capacité à formuler et à mettre en œuvre des politiques publiques font l’objet de discussions dans le cadre de ces négociations. En réaction, plusieurs États fédérés souhaitent être inclus dans la dynamique multiniveau des négociations commerciales. La capacité d’influence des États fédérés est cependant asymétrique et dépend largement de leur statut constitutionnel. Cet article compare le rôle du Québec et celui de la Région wallonne dans les négociations commerciales entre le Canada et l’Union européenne. Alors que la Région wallonne a pu imposer l’inclusion d’un instrument juridique interprétatif pour clarifier certaines parties du traité en menaçant d’opposer son veto à la signature belge, le Québec, comme les autres provinces canadiennes, a influencé la négociation de l’intérieur laissant sa marque sur plusieurs éléments du traité.
