Cet article porte sur l’expansion du mandat de l’Agence européenne de garde-frontières et de garde-côtes (Frontex) depuis sa création en 2005. Il analyse l’impact des pouvoirs grandissants de l’Agence sur les droits humains des migrants. Comme le montre le Nouveau Pacte sur la Migration et l’Asile de 2020 , l’Agence bénéficie d’un soutien politique sans faille dans la gestion intégrée des frontières extérieures des États membres de l’Union européenne. Elle peut notamment procéder à des opérations conjointes maritimes, terrestres et aériennes de contrôle des mouvements migratoires et de renvois forcés, en plus de pouvoir déployer des agents dans les pays tiers. En 2021, un contingent permanent du corps européen de garde-frontières et de garde-côtes doté de pouvoirs d’exécution verra le jour. Nous soutenons que cette expansion considérable reflète la préférence de l’UE et de ses États membres de répondre à la pression migratoire essentiellement par des mesures de sécurisation de leurs frontières afin de dissuader et réprimer des migrants indésirés. Cette approche est non seulement contre-productive mais aussi elle engendre de graves atteintes aux droits des migrants visés, y compris des demandeurs d’asile. Malgré certaines améliorations apportées au mandat de l’Agence pour un meilleur respect des droits humains, ce but est loin d’être atteint. L’absence de règles claires d’imputation de responsabilité et d’un recours effectif en cas d’atteintes aux droits est particulièrement problématique.
