Abstract

Este estudo tem por objeto o exame de algumas inovações disruptivas na medicina, notadamente a epigenética, a inteligência artificial (IA) e a telemedicina, sob uma perspectiva humanista, justificada nas bases axiológicas do Direito. Fez-se um panorama dos principais avanços científico-tecnológicos no campo da medicina, e, sem descuidar da sua importância para a sociedade, procurou-se demonstrar como tais progressos podem se revelar perigosos para a preservação de dados pessoais e a garantias, como a intimidade e a privacidade. Por fim, diante da necessária incidência do Direito sobre as relações interpessoais e do papel centralizador da dignidade da pessoa humana, justificou-se o atributo da empatia nas relações médico-cliente como traço insubstituível ante qualquer mecanismo de inteligência artificial (IA) ou tecnológico.
