Les interventions sociales et médico-sociales sont bien soumises aux principes du droit européen et français de la concurrence, du fait de leur reconnaissance généralement comme services d’intérêt économique général ( sieg ) plutôt que comme services d’intérêt non économique général. La portée de ce droit à leur égard reste toutefois encore limitée, compte tenu des dérogations multiples qu’il prévoit, notamment en faveur des sieg . Mais les évolutions en cours (nouveau management public, concentrations, offensives des organismes lucratifs) exigent de la part des organismes sociaux et médico-sociaux qu’ils connaissent ce droit pour conforter leurs financements publics, garantir et promouvoir leur travail social, souvent méconnu des administrations et des juges. Au nom de la concurrence, ces derniers risquent, sinon, de condamner les financements, la coopération et les partenariats indispensables à une action sanitaire et sociale adaptée aux besoins des bénéficiaires.
