תקציר בעברית: חברות דמוקרטיות מגיבות על צורך מוסרי - ותכופות גם על כורח פוליטי הנוגע ביציבותן - לגונן על בני־אדם המשתייכים לקבוצות מיעוט בתוכן. לשם כך הן מאמצות נתיבי הגנה מגוונים למדי המשתרעים על תחומי פעולה חברתיים שונים, ביניהם משפט וחינוך. בין האמצעים המשפטיים בולט איסור ההפליה על בסיס השתייכות קבוצתית. אמצעי נוסף - מורכב יותר ושנוי יותר במחלוקת - הוא יישום מדיניות של ״העדפה מתקנת״, בעיקר כלפי בני אותן קבוצות שהדרתן החברתית הינה כרונית. אחד מביטוייה של ״ההעדפה המתקנת״ קרוי ״ייצוג הולם״, והוא מוקד ענייננו כאן. טעם חשוב לכתיבת מאמר זה נעוץ באחד מפסקי־הדין המרכזיים שנתן בית־המשפט העליון בישראל בעניינו של הייצוג ההולם. מדובר בפסק־הדין שהורה לממשלה לפעול לייצוגם של ערבים במועצת מנהל מקרקעי ישראל. פסק־דין זה גירה את סקרנותנו בשל השילוב של מה שנפסק בו עם מה שנעדר ממנו. מחד גיסא, גיבש פסק־הדין מהלכים חדשניים: הוא הצהיר על התגבשותה של חובה מכוח הפסיקה - להבטיח ייצוג הולם למיעוט הערבי־הפלסטיני במכלול השירות token) הציבורי הישראלי; הוא הדגיש כי היקף החובה אינו מתמצה ב״נוכחות סמלית״ של אדם מהקבוצה המוגנת בגוף הציבורי שהרכבו נבחן; והוא הבהי (representation נקודה רבת־משמעות נוספת - הצורך הקיים לעיתים באסימטרייה, קרי, בהתייחסות לא־אחידה לקבוצות שונות בחברה הישראלית:השאלה מהו ייצוג הולם בגוף מסויים תלוייה, בין היתר, במהות הגוף, ובכלל זה בחשיבות המעשית של הגוף מבחינת הקבוצה הזכאית לייצוג הולם. בהתאם לכך נראה כי חשיבות הייצוג ועוצמת הייצוג במינהל מקרקעי ישראל גדולה לגבי בני האוכלוסיה הערבית יותר מאשר, לדוגמה, לגבי אנשים עם מוגבלות. מאידך גיסא, תרומתו של פסק־הדין לקידום מעמדו של המיעוט הערבי־הפלסטיני בישראל נתונה בספק, בין היתר, בשל העדרו של יסוד חשוב. פסק־הדין שותק ביחס לאופן בחירתם של בני קהילת המיעוט שישתתפו בהרכבה של מועצת מנהל מקרקעי ישראל. הוא אינו קובע דבר ביחס לזיקה בין הבחירה באדם לבין עמדתה של קבוצתו כלפיו. אכן, בפסק־הדין מצוי רמז לבעיה של ממש שהעלו העותרים - טענתם שלפיה ״הנציג״ הערבי שנבחר למועצת מנהל מקרקעי ישראל היה חסר כישורים, ״לבד״ מהיותו חבר במרכז הליכודככלל, במצב־הדברים הנוכחי בישראל, בני קהילת המיעוט אינםמעורבים (בין באמצעות נבחרי ציבור, גופים יציגים שונים או ארגוני חברה אזרחית בקרבם) בבחירת הזוכים במינוי מכוח מדיניות ״הייצוג ההולם״ כלפי קבוצתם, גם לא כאשר מדובר בתפקידי־מפתח ניהוליים בשירות הציבורי ובגופים המלווים אותו.מצב־דברים זה, וטעמים נוספים, כיוונו אותנו למהלך תיאורטי קצר ולמהלך השוואתי מעט ארוך יותר. המהלך התיאורטי הוא הצבעה על שני םוגים שונים של ייצוג הולם.המהלך ההשוואתי הוא המחשתם המפורטת של שני סוגים אלה באמצעות המקרה הקנדי, והתבוננות מקבילה (וחלקית) על ישראל. המאמץ העיקרי שייעשה הוא שרטוט המסגרת המפורטת של כל אחד משני סוגי הייצוג ההולם המופעלים בקנדה. כל אחת משתי מסגרות הניתוח שישורטטו מכילה לקחים ויתרונות שעשויים לשמש השראה לתיקונה ולשכלולה של מדיניות הייצוג ההולם הנוהגת בישראל - למן סוף שנות התשעים - כלפי נשים, אנשים עם מוגבלות וערבים. בחלק האחרון של המאמר נפנה לעיון ראשוני בעניינה של אחת מבין אותן קבוצות - המיעוט הערבי־הפלסטיני - וננסה להבין באופן בהיר יותר מה מקשה כל בך על השגת שינוי של ממש במצבו של מיעוט זה בתחום הייצוג ההולם לסוגיו.
