Abstract
EnglishThis paper argues that Canadian constitutional culture relies on a general narrative, that the Canadian Constitution is unfinished; a series of conceptual metaphors instantiate this narrative. Each conceptual metaphor frames different conditions — which may or may not be consistent — to justify constitutional practices. Understanding the justifying logic at play gives us the key to a more meaningful comparison between Canadian judicial constitution-making and other forms of constitution-making, both within Canada or in other constitutional orders. francaisL’auteur de cet article soutient que la culture constitutionnelle canadienne repose sur un recit general (« la constitution canadienne est inachevee ») et une serie de metaphores conceptuelles qui instancient ce recit. Chaque metaphore conceptuelle definit et formule les differentes conditions permettant de considerer comme justifiees les pratiques constitutionnelles. Ces conditions peuvent parfois — meme souvent — etre coherentes mais elles peuvent egalement ne pas l’ etre. Une comprehension des logiques justificatrices qui entrent en jeu nous fournira la cle d’une comparaison plus significative de l’elaboration d’une constitution judiciaire canadienne et d’autres formes d’elaboration d’une constitution, soit a l’interieur du Canada, soit dans d’autres ordres constitutionnels.
