Abstract
En février 2016, une exception au droit du commerce américain a été retirée par l’adoption d’un amendement législatif qui interdit l’importation de produits issus du travail forcé. Le Canada pourrait suivre le pas du législateur américain dans les prochains mois avec l’adoption d’un projet de loi sénatorial. Cette « permission d’interdiction » n’est pas sans rappeler le libellé de certains accords commerciaux régionaux et bilatéraux et de conventions internationales du droit du travail. Cet article dresse d’abord le portrait des clauses du travail dans les accords commerciaux régionaux et bilatéraux auxquels est partie le Canada, pour ensuite aborder la notion de travail forcé ou obligatoire. Enfin, et c’est là la contribution de ce texte, le nouveau modèle américain d’interdiction d’importation des produits issus du travail forcé est présenté et comparé aux derniers développements législatifs canadiens en la matière.
