Abstract
Le sentiment paraît antinomique avec la rationalité du raisonnement juridique suivi par le juge administratif français. Pourtant, tout en gardant le silence sur les sentiments humains, il les prend en considération, principalement dans le contentieux de la responsabilité, pour réparer les préjudices moraux. Il est aussi réceptif au sentiment propre à l’Humanité, à savoir la dignité de la personne humaine et la compassion qu’elle inspire. Plus généralement, le sentiment de justice anime le juge administratif et explique sa recherche incessante de perfectionnement du droit, à travers notamment le sentiment d’indignation qu’il peut ressentir et la réalisation de l’égalité pour lutter contre le sentiment de discrimination.
