Abstract
Qu’est-ce que le droit a à apporter au débat, désormais vigoureux, se déroulant en économie, sociologie, psychologie, philosophie, études littéraires et anthropologie sur la nature et les sources de l’espoir dans la vie personnelle et sociale ? En quoi peut-il contribuer à l’espoir ? Est-il porteur d’une quelconque espérance ? Plutôt que de se concentrer sur les finalités du droit (la justice sociale, l’efficacité économique…), cette étude porte sur ses moyens (ou techniques juridiques). La critique des travaux de Hans Vaihinger, Morris Cohen et Pierre Schlag, sur les techniques et fictions juridiques, permet de dégager le fait que le droit est porteur d’espoir par ses qualités en matière de « faire semblant ».
