Abstract
In the decision under comment, the Supreme Court of Canada provides an interpretation of the conditions for international lis pendens (art. 3137 CCQ). The Court accepts a light burden of proof for the condition of susceptibility of recognition of foreign judgment. The author instead favours the more restrictive dissenting position. The Supreme Court—rightly, according to the author—rejects a more restrictive conception of the discretionary authority not to accept lis pendens. Incidentally, the author proposes an interpretation of the legislation that applies to the revocation of gifts between spouses and criticizes the interpretation provided in this case of the rules governing indirect international jurisdiction in matters of divorce.
