Abstract
La vérification de la cote de crédit du consommateur avant de lui offrir des services est une pratique répandue au Québec. C’est ainsi qu’une inscription négative à son dossier de crédit peut priver le consommateur de certains services (prêt hypothécaire, location de logement ou de voiture, assurance, etc.) ou lui imposer des conditions plus onéreuses (taux d’intérêt plus élevé, prime d’assurance plus élevée). Si la victime d’une inscription erronée ou injustifiée peut être indemnisée pour le préjudice découlant de sa perte de solvabilité, plusieurs embûches se dressent toutefois devant elle, à savoir la preuve de la faute et celles du dommage et du lien de causalité.
