Abstract
La determination du conge hospitalier d’une personne vulnerable necessite une collaboration etroite avec les proches aidants. Or ceux-ci se retrouvent souvent a assumer une grande part de responsabilite concernant l’assistance a fournir une fois de retour a domicile, sans qu’ils n’aient formellement consenti ni recu une formation adequate pour prodiguer de tels soins. Cette situation a des effets deleteres sur la sante des proches aidants. Une analyse du cadre juridique quebecois concernant les proches aidants revele que ce dernier est insuffisant pour les proteger adequatement. Cet essai vise a soulever des solutions novatrices a ce constat, soit la creation d’une loi particuliere precisant le statut de proche aidant et l’etablissement d’un cadre juridique precisant leurs droits, leurs obligations et les elements de leur responsabilite civile notamment en cas de faute commise par le proche aidant dans le cadre de son role. Abstract When a vulnerable person is discharged from hospital, there should be a close collaboration between the medical staff and the caregivers who will be looking after that person upon their release. Caregivers often find themselves having to take on greater responsibilities when their patients return home, yet they do so without having provided formal consent and without adequate training. This situation has deleterious effects on the caregivers’ health. An analysis of Quebec’s legal framework for caregivers reveals that they are not adequately protected. This article identifies some innovative solutions, including the creation of legislation recognizing the status of caregivers and establishing a legal framework that outlines their rights, obligations and civil liability (most notably in the case of malpractice by the caregiver).
