Abstract
Rumusan masalah dalam penelitian ini adalah bagaimana aturan hukum tentang pemakaian bidang tanah tanpa izin yang berhak atau kuasanya, bagaimana penegakan hukum dan faktor kendalanya terhadap tindak pidana pemakaian bidang tanah tanpa izin yang berhak atau kuasanya di Wilayah Hukum Kepolisian Daerah Sumatera Utara. Diperoleh hasil bahwa aturan pidana pemakaian tanah tanpa izin diatur dalam Perpu Nomor 51 Tahun 1960 tentang Larangan Pemakaian Tanah Tanpa Izin Yang Berhak Atau Kuasanya. Pada pasal 2 dan pasal 6 Perpu tersebut dinyatakan bahwa pemakaian tanah tanpa izin dari yang berhak maupun kuasanya yang sah adalah perbuatan yang dilarang. Penegakan hukum dikepolisian diawali dengan menerima laporan dari masyarakat, kemudian dilanjutkan dengan penyidikan, dan berakhir dengan pelimpahan berkas perkara dan tersangkanya kepada jaksa penuntut umum. Faktor kendala adalah kesulitan membedakan perkara pidana dengan perkara perdata dalam kasus pertanahan, adanya dualisme aturan hukum, sering sulit membedakan keaslian bukti kepemilikan tanah, terdapat instansi yang berbeda mengeluarkan bukti kepemilikan atas bidang tanah yang sama pada pihak yang berbeda, serta adanya intervensi dari oknum-oknum dipemerintahan ataupun dari oknum kepolisian.
