Abstract
Les travaux de jeunesse de Max Weber consacrés aux conditions du travail agricole en Allemagne à l’est de l’Elbe demeurent peu connus. Leur antériorité par rapport à la sociologie wébérienne proprement dite, la primauté apparente des jugements de valeur en leur sein et un caractère historique fortement daté peuvent expliquer ce manque d’intérêt. L’auteur adopte ici résolument le point de vue contraire. En particulier, même si cette terminologie n’apparaît pas encore, Weber y observe avec rigueur des processus de rationalisation notamment économique (passage du domaine patriarcal à l’exploitation capitaliste) et juridique (de la tenure féodale au contrat de travail « libre ») dont il s’agit d’explorer les multiples tensions et antinomies. Par ailleurs, si l’on s’attache au concept central de ces études, celui de la « constitution du travail », la notion présente un intérêt indiscutable – et universel – pour l’étude de la dynamique des rapports de travail dans le cadre de la modernité. Il paraît toutefois indispensable de réinterpréter la notion en tenant compte des travaux de maturité de Weber, notamment de sa sociologie du droit telle qu’elle se dégage en particulier d’Économie et société.
