Abstract
La détermination des unités de négociation, élément crucial de cristallisation de la liberté d’association depuis l’adoption au Canada du modèle Wagner (1944), obéit à des règles différentes du régime général dans le secteur public. En règle générale, la détermination de l’unité d’accréditation y repose avant tout sur des critères fonctionnels, telles la structure organisationnelle de l’entreprise ou la similarité des fonctions et des conditions de travail, par opposition à des critères volontaires qui feraient entrer en jeu, en toute priorité, les choix associatifs des employés. Dans le présent texte, l’auteur retrace l’historique de la détermination des unités de négociation dans le secteur public fédéral et examine les composantes respectives des approches fonctionnelle et volontaire, en comparant deux situations types, soit celles qui sous-tendaient les demandes de fragmentation des unités de négociation à la Société Radio-Canada en 1978 et chez les contrôleurs aériens au Québec en 1979. Les types idéaux du fonctionnalisme et du volontarisme sont ensuite mobilisés pour l’analyse de la situation contemporaine à la Gendarmerie royale du Canada, laquelle a fait l’objet, au regard de la liberté constitutionnelle d’association, d’une décision récente (juillet 2019) de la Commission des relations de travail et de l’emploi dans le secteur public fédéral.
